Agreement and Liability Release<P>

Read carefully before signing

I am in complete agreement to the following with SPECIAL T CARRIAGE CO.  As a condition for it's allowing me and other persons identified below, including any persons involved with my party that may not be listed below, to enter the property, be near the horses, receive driving instruction, and or ride on the carriages, wagons or horses.

All parts of this agreement shall apply to me, and the children/wards listed above.  (We will collectively call ourselves "I", "me", or "my" throughout this agreement.)  This agreement is binding when the SPECIAL T CARRIAGE CO. permits me to enter the property, be near the horses, and or ride on the carriages/wagons, on or off of the property.

IT IS HEREBY AGREED AS FOLLOWS:
1). I have requested to enter the premises and ride carriages, wagons and be in contact with horses, on, near, or off of the stable's property.
2). I understand that anyone riding or near a horse can suffer bodily and other injuries.  I also understand that no matter how well a horse is trained, they are powerful and may be unpredictable.  

I understand the risks, and voluntarily agree to assume them.

3). As a condition of the stable allowing me to enter the property, near horses, carriages or wagons, I waive all rights to bring any legal or lawsuit proceeding against SPECIAL T CARRIAGE CO. and their respective officers, partners, employees, heirs, insurers or any others acting on their behalf for any injury, death, or incident arising out of being on the property or off, being near or riding the horses, carriages and wagons.
 4). Liability Release:  I assume full responsibility for any and all bodily injuries or damages which I may sustain when on, in, near, or off the discharge SPECIAL T CARRIAGE CO. properties or equipment.  The term "damages" means medical expense, any and all expenses or losses incurred due to any and all types of injuries,  property damages, and/or damages for my heirs, administrators, personal representatives or assigns, release and discharge SPECIAL T CARRIAGE CO. and all others acting on their behalf of and from all claims, demands, actions, omissions, rights of action, or causes of action (present and future), whether the same be known or unknown, anticipated or unanticipated, resulting or arising out of my or my guests' bodily injury or damage that may be sustained, or property damage which may occur as a result of being near, on, or off the premises, property  or riding horses or in carriages or any equipment belonging to or being used by discharge SPECIAL T CARRIAGE CO.
5). Indemnification:  I also agree hereby to indemnify and hold harmless SPECIAL T CARRIAGE CO. and their respective officers, partners, employees, heirs, insurers or any others acting on their behalf against any and all damages sustained or suffered by any third person(s) who are parties to this agreement, including but not limited to my relatives, guests, etc. including any and all damages or injuries whatsoever that may arise while being on or off the premises of SPECIAL T CARRIAGE CO., near or on the horses, carriages, wagons, or around the stable's property.
6). I am fully responsible for my own safety while on, near, or off of SPECIAL T CARRIAGE  CO. properties, horses, or equipment.  I also represent that I am and will at all times be covered by my own accident and or medical insurance, or I have sufficient funds to cover any incidents arising out of my being on, near, or off of SPECIAL T CARRIAGE  CO. properties, horses, or equipment.

7). Oregon Law shall govern this agreement. Should any clause conflict with Oregon law, that law shall be null and void and the remainder of this agreement shall remain in effect. In the event that legal action is taken, in which SPECIAL T CARRIAGE CO. enforces this agreement, I agree to pay SPECIAL T CARRIAGE CO. court and attorney fees if SPECIAL T CARRIAGE CO. should prevail.
8). I represent that I am 18 or over years of age, of sound mind, and not suffering from shock or under the influence of alcohol, drugs or intoxicants.  I have not been forced to sign this agreement against my will, I have read this entire agreement and liability release.  I understand it and the information provided herein is true and accurate.
